Webinar CEA: Nueva normativa de garantías, ¿Cómo afecta a la venta del vehículo nuevo y de ocasión si eres autónomo/empresario?

El próximo miércoles 2 de febrero la Confederación de Empresarios de Andalucía (CEA) organiza una Webinar sobre la nueva normativa de garantías sobre la venta de vehículo nuevo y de ocasión si se es autónomo o empresario y como afecta esa operación.

Por ello, en esta jornada informativa, se intentará desgranar el Real Decreto-ley 7/2021, de 27 de abril, que se aplica desde el 1 de enero de este año y analizar las consecuencias que tiene en el sector del vehículo nuevo y de ocasión, en especial si se es autónomo o empresario de Pyme. Esta norma trae consigo una serie de modificaciones en materia de garantía que afectan a la venta de vehículos:

El plazo de garantía pasa de 2 a 3 años en la venta de vehículos nuevos. En el caso de los vehículos de ocasión, podrá seguir pactándose un plazo mínimo de 1 año.

El periodo en que la carga de prueba corresponde al vendedor sube a 2 años, si bien en los vehículos de segunda mano podrá pactarse un periodo mínimo de 1 año (actualmente es 6 meses).

El plazo para comprobar que una reparación en garantía es correcta, aumenta de 6 meses a 1 año.

El plazo de prescripción de las acciones judiciales pasa de 3 a 5 años.

El plazo de disponibilidad de repuestos y atención en servicio técnico sube de 5 a 10 años.

Con respecto a los ponentes que expondrán esta serie de modificaciones que trae el Real Decreto, la webinar de la Confederación de Empresarios de Andalucía tendrá la participación de Jaime Barea Navamuel; Director Corporativo de la Asociación Nacional de Vendedores de Vehículos a Motor, Reparación y Recambios (GANVAM); e Inés Hernández; Responsable de Asesoría Jurídica Asociación Nacional de Vendedores de Vehículos a Motor, Reparación y Recambios (GANVAM).

Por su parte,  Lola Gessa Sorroche, Reponsable de PRL y Consumo de la Confederación de Empresarios de Andalucía (CEA), será la encargada de presentar la Webinar.

On Wednesday 2 February, the Andalusian Confederation of Entrepreneurs (CEA) is organising a Webinar on the new warranty regulations on the sale of new and second-hand vehicles if you are self-employed or an entrepreneur and how this operation is affected.

The aim of this informative seminar will be to explain Royal Decree-Law 7/2021 of 27 April, which has been in force since 1 January this year, and to analyse the consequences for the new and second-hand vehicle sector, especially if you are self-employed or an SME entrepreneur. This regulation brings with it a number of changes to the warranty that affect the sale of vehicles:

The warranty period increases from 2 to 3 years for the sale of new vehicles. In the case of second-hand vehicles, a minimum period of 1 year may continue to be agreed.

The period for which the burden of proof lies with the seller increases to 2 years, but for second-hand vehicles a minimum period of 1 year may be agreed (currently 6 months).

The period for proving that a repair under warranty is correct increases from 6 months to 1 year.

The limitation period for legal action increases from 3 to 5 years.

The period for the availability of spare parts and technical service increases from 5 to 10 years.

With regard to the speakers who will present this series of modifications brought about by the Royal Decree, the webinar of the Andalusian Confederation of Entrepreneurs will have the participation of Jaime Barea Navamuel; Corporate Director of the National Association of Motor Vehicle Dealers, Repairs and Spare Parts (GANVAM); and Inés Hernández; Head of Legal Consultancy of the National Association of Motor Vehicle Dealers, Repairs and Spare Parts (GANVAM).

Lola Gessa Sorroche, Head of PRL and Consumer Affairs at the Andalusian Confederation of Employers (CEA), will be in charge of presenting the Webinar.
